FEDERAL MOTOR CARRIER SAFETY ADMINISTRATION (FMCSA) - Available for companies that must meet the FMCSA requirements. This program complies with the DOT FMCSA requirements and provides random drug selection at 25% and random alcohol selection at 10% per calendar year as required by CFR 49 Part 382. Company (non-regulated) anti-drug and alcohol misuse plan is included with this program with the option to maintain a non-regulated random program. 


PIPELINE AND HAZARDOUS MATERIAL SAFETY ADMINISTRATION (PHMSA) - Available for companies that must meet the PHMSA requirements. This program complies with DOT PHMSA requirements and provides random drug selection at 25% per calendar year as required by CFR 49 Part 199. Company (non-regulated) anti-drug and alcohol misuse plan is included with this program with the option to maintain a non-regulated random program.


UNITED STATES COAST GUARD (USCG) NOW A PART OF HOMELAND SECURITY - Available for companies that must meet the USCG requirements. This program complies with DOT USCG requirements and provides random drug selection at 50% per calendar year as required by CFR 49 Parts 16 and 4. Company (non-regulated) anti-drug and alcohol misuse plan is included with this program with the option to maintain a non-regulated random program.

FEDERAL RAILROAD ADMINISTRATION (FRA) - Available for companies that must meet the short and/or long railroad FRA requirements. This program complies with DOT FRA requirements and provides random drug selection at 25% and random alcohol selection at 10% per calendar year as required by CFR 49 Part 219. Company (non-regulated) anti-drug and alcohol misuse plan is included with this program with the option to maintain a non-regulated random program. 

 

Non-Regulated Programs 

COMPANY (NON-DOT) - Available for companies that are not required by DOT. This program complies with diverse company specific needs. Random drug and/or alcohol selection rates are optional. If a non-regulated program is implemented by your company it is recommended to set a standard and treat all employees subject to this program the same to eliminate any discrimination issues. PES, Inc. will select random testing via computerized method on a quarterly basis. See below some of the options to consider when implementing a non-regulated program.

  • Choose job functions (NOT People) within your company that will be applicable.
  • Decide whether it is best to perform pre-employment testing only or if your company needs random testing as well.
  • If a random program is needed, decide whether drug and alcohol random testing is needed or just drug testing.
  • If a random program is needed, decide what rate to select random testing. If your company has 10 or less non-regulated employees, your employees will be placed in a consortium pool with other companies for random selection if you choose a percentage rate. If your company has 10 or less non-regulated employees, but you wish for a specific low number of random tests each quarter, your employees do not have to participate in a consortium pool. If your employees participate in a consortium pool, the random selection test numbers are inconsistent per quarter meaning that you may have random selections one quarter and the possibility of no random selections the next quarter. 


OPERATOR REQUIRED COMPANY (NON-DOT) - As a contractor, your company may be subject to operator Non-regulated requirements. PES, Inc. provides consortium members with Company (Non-DOT) drug/alcohol plans and addendums that meet operator specific requirements. PES, Inc. provides drug/alcohol programs meeting Encana Oil & Gas requirements as well. Depending on the specific operator, the random selection rate and/or annual testing and drug testing panels will be determined by the operator requirements. 

TEXAS DEPARTMENT OF LICENSING AND REGULATION (TDLR NON-DOT TOWING OPERATORS AND VEHICLE STORAGE FACILITIES) - If your company employees towing operators or vehicle storage facility employees in the state of Texas, you must have a non-DOT drug/alcohol program complying with Texas Department of Licensing and Regulation Vehicle Storage Facility and Towing Administrative Rules 16 Texas Administrative Code Part 4 Chapter 85.725 and 86.710. Panhandle Employers Services, Inc. is approved by TDLR to provide drug/alcohol programs keeping Texas Towing Facilities in compliance.
